Dussehra Rally: Setback To Shinde Sena As Bombay HC Permits Uddhav Thackeray To Hold Dussehra Rally

Bombay High Court’s decision is considered a big blow to Eknath Shinde group as Uddhav Thackeray won the Shivaji Park Battle

Mumbai: Bombay High Court permitted Shiv Sena chief Uddhav Thackeray to hold Dasara Rally at Shivaji Park. The court has given permission for Shiv Sena’s Dussehra gathering on October 5. The court’s decision is considered a big blow to the Shinde group. Shiv Sena won the Shivaji Park battle after the court gave permission on September 23.

Advocate Aspi Chinoy said, “The state government has passed an ordinance in 2016 stating that the government has allowed Shiv Sena to hold a meeting on Dussehra day. Only due to covid for the last two years, the Dussehra rally was not conducted.” This year, Shiv Sena leader Anil Desai sought permission for the Dussehra gathering. But, it was rejected by the municipality on the grounds of law and order.

During the hearing held today, the court heard the arguments of all the three sides. After this the court announced its decision in favor of Thackeray. The court dismissed the petition of Shinde group MLA Sada Saravankar before giving its decision. On the decision of the municipality, the court reprimanded the Mumbai Municipal Corporation saying that the municipality had abused its authority.

After Shiv Sena, MLA of Shinde group Sada Saravankar also filed a petition for Dussehra Rally. After this, the court rejected the petition of Shinde group. And during the hearing, court noted that the decision given by the Mumbai Municipal Corporation is not based on reality. Also, this court has mentioned that the question of law and order arises in view of the strength of the Dadar police.

Municipal Corporation While Denying Permission For Dusshera Rally Said:

It has been informed through the medium that the municipality had denied permission citing the issue of law and order. In the letter, the municipality has denied permission to both groups to gather based on the feedback from the police. While refusing permission, the municipality said, “Both sides had applied to organize Dussehra Rally at Shivaji Park. However, if permission is granted to one applicant for the gathering, it may create a serious law and order problem in the sensitive area of ​​Shivaji Park,” the municipality explained while denying the permission.
