The Apex court today dismissed the plea filed by Uddhav Thackeray fraction requesting to stay proceedings in front of Election Commission regarding the Shiv Sena sign and symbol, dealing a blow to Thackeray scion, already weakened by the rebellion by Eknath Shinde and his supporter MLAs. The constitutional bench headed by Justice DY Chandrachud said the proceedings will continue in front of the EC. Uddhav Thackeray had approached the top court urging to stay proceedings in EC before the court decides on the matter regarding the disqualification of MLAs.
Uddhav Thackeray-led MVA government in Maharashtra had collapsed after a rebellion led by senior Shiv Sena leader Eknath Shinde. Over 30 MLAs, including ministers in the government, had joined Shinde in an open confrontation with party supremo Thackeray.
Shinde then went on to form a government with the BJP. He was sworn in as Chief Minister on June 30, with the BJP’s Devendra Fadnavis as his deputy.
Petitions filed by the Uddhav Thackeray and Shinde-led factions raising several constitutional questions related to defection, merger and disqualification was referred by the SC to a five-judge bench on August 23.
