“Nothing Wrong In Trial Court Order”: Bombay HC Refuses Relief To Raj Kundra

Mumbai| Businessman Raj Kundra, at the center of Porm films racket unearthed by the Mumbai Police, has got another jolt from the court today. The Bombay High Court has rejected his plea not to arrest him and release him immediately. Kundra will have to remain in jail for now. The High Court in its order said, “There is nothing wrong in the order of the Magistrate Court in which the trial court had sent Raj Kundra to police custody on July 20.” Kundra and his business partner Ryan Thorpe had challenged the magistrate’s court’s remand order and sought immediate release.

Raj Kundra in his application had called his arrest illegal. He said that Section 41A of CrPC was not followed in this. The petition said that the sections under which the case has been registered against Kundra have a provision of maximum punishment of seven years. In such a situation, it is completely illegal to arrest Kundra without following the legal provisions.

Businessman Kundra, along with one of his associates, Ryan Thorpe, was arrested on July 19 for their involvement in the making of pornography videos. However, they have argued that the material in question was not pornography and similar material is available on OTT platforms.

On the other hand, Mumbai Police has claimed that during investigation it was found that Kundra started Armsprime Media Pvt Ltd which purchased Hotshots app through Kenrin Pvt Ltd of London for uploading objectionable videos on social media. Police also alleged that Kundra earned over Rs 1.17 crore between August and December last year through Hotshots. The police also claimed to have found 51 objectionable videos during the raids on the office of the accused.

On Friday, the city police interrogated actress Sherlyn Chopra for hours to nab the people involved in this racket. The property cell department of Mumbai Police had summoned Sherlyn Chopra for questioning under 160 CrPC.
