“The 84th Amendment of the Constitution states that the next delimitation of constituencies boundaries in India would be initiated after 2026. So, does the J&K delimitation 2022 violate this constitutional amendment?
The Jammu and Kashmir Reorganization act 2019 was enacted for several reasons, but also to permit delimitation of boundaries in J&K anytime the government so decides. With Article 370 abrogated and the assembly dissolved, fresh elections became imperative.
However, why could the government not carry out the elections as per the current seat allocations? 2026 is only four years away, and if a delimitation were to be carried out, it would have been better under a popular government rather than under President’s rule.
Neither the population growth nor the state area warrants new constituency boundaries. So what could be the reason?
