The Supreme Court has granted bail this Friday to Sheikh Javed Iqbal, a Nepali citizen detained under the Unlawful Activities Prevention Act (UAPA). The bench of Justices J B Pardiwala and Ujjal Bhuyan cited Iqbal’s nine-year incarceration with only two witnesses’ testimonies and emphasized that “statutory restrictions would not come in the way” if fundamental rights under Article 21 were infringed. This ruling follows precedents set in the 2021 K A Najeeb case and an April 2024 decision involving Shoma Sen.
