Congress Files Plea In Supreme Court Over Election Rule Tweak

On Tuesday the Congress party filed a writ petition in the Supreme Court. The petition challenges the recent amendments to the Conduct of Election Rules, 1961. It further stated that the integrity of the electoral process was fast eroding.

According to PTI, the government has tweaked an election rule to prevent public inspection of certain electronic documents. This includes CCTV camera and webcasting footage as well as video recordings of candidates to prevent their misuse.

The petition was filed by AICC general secretary Jairam Ramesh. In the petition, he stated “The integrity of the electoral process is fast eroding. Hopefully, the Supreme Court will help restore it.”

According to Jairam Ramesh, the Election Commission is tasked to conduct free and fair elections. Hence, it cannot be allowed to unilaterally amend such a vital law in such a brazen manner.

In a post on, X Jairam Ramesh wrote, “A writ has just been filed in the Supreme Court challenging the recent amendments to the Conduct of Election Rules, 1961. The Election Commission, a Constitutional body, charged with the conduct of free and fair elections cannot be allowed to unilaterally, and without public consultation, amend such a vital law in such a brazen manner,”

He further wrote This is especially true when that amendment does away with public access to essential information that makes the electoral process more transparent and accountable.

According to reports, based on the recommendation of the Election Commission. The Union Law Ministry on Friday amended Rule 93(2)(a) of the Conduct of Election Rules, 1961. The rule restricts the type of “papers” or documents open to public inspection.
