On Friday, the Supreme Court rejected an interim stay for the new law, excluding the Chief Justice of India from the panel selecting the Chief Election Commissioner and election commissioners. The plea was filed by Congress leaders Jaya Thakur and Sanjay Narayanrao Meshram, challenging the law as a violation of the separation of powers. The bench, led by Justice Sanjiv Khanna, issued notice and declined the stay, citing an inability to stay a statute. Senior Advocate Vikas Singh argued that the law contradicted the March 2, 2023, Constitution bench ruling, which mandated the involvement of the Prime Minister, Leader of the Opposition, and Chief Justice of India in the committee for appointing the CEC and ECs.
