SC Agrees To List Matter In Notifying Recommendations On Appointment Of Judges In Higher Judiciary

The Supreme Court on Wednesday agreed to list for hearing a matter seeking direction to the Centre to immediately notify all recommendations for the appointment of judges that have been sent to it by the apex court Collegium.

New Delhi:  The Supreme Court on Wednesday agreed to list for hearing a matter seeking direction to the Centre to immediately notify all recommendations for the appointment of judges that have been sent to it by the apex court Collegium.

A bench of Chief Justice of India DY Chandrachud and Justices Hima Kohli and JB Pardiwala said it will list the matter after advocate Prashant Bhushan mentioned the matter for the listing of the case. Bhushan, while mentioning the matter said, โ€œWe are seeking a mandamus to the government. This plea was filed in 2018 and nothing was listed.โ€

To this CJI said, โ€œThis will be listed. I will pass administrative orders.โ€ NGO Centre for Public Interest Litigation (CPIL) had filed a plea alleging that the Centre has been โ€œindefinitely sittingโ€ on the names recommended by the Supreme Court Collegium for appointment of judges in the higher judiciary.

The plea has sought a direction to the Centre to notify the appointment of judges for the Supreme Court and different High Courts whose names have already been unanimously reiterated by the Collegium and are pending with the government.

It had also sought a direction to the government to notify the recommendations for appointments of judges to various High Courts that have been sent by the Collegium and the Centre has not responded even though six weeks have passed since the recommendations were received.

The plea had also alleged that important constitutional positions cannot be left vacant merely because of the โ€œinactionโ€ of the government and its โ€œpolitically motivated interference in the judicial appointment processโ€.

The NGO highlighted many recommendations which were sent by the Collegium but not acted upon by the government.

Kolkata: The leader of the opposition Suvendu Adhikari Wednesday skipped Dr CV Ananda Boseโ€™s oath-taking ceremony as West Bengal governor over seat arrangements and termed chief minister Mamata Banerjee as the โ€˜most wretched politician ever born in India.โ€™

In a series of tweets right before the oath-taking ceremony, he made it clear that he would not attend it as he was made to sit next to MLAs Krishna Kalyani and Biswajit Das, who got elected on BJP tickets but later defected to the ruling TMC. In one of his five tweets, Suvendu stated โ€œThe LoP has been made to sit next to โ€˜soon to be disqualifiedโ€™ MLAs Krishna Kalyani & Biswajit Das. Both got elected on BJP tickets & later defected to TMC, so Anti-Defection proceedings are going on against them.โ€

โ€œI wonโ€™t be attending the ceremony as itโ€™s not possible for me to take a seat next to such objectionable personsโ€, he added.

Holding West Bengal chief minister Mamata Banerjee responsible for all this, he stated โ€œThe Information & Cultural Affairs Dept; WB Govt has made the arrangements for the oath-taking ceremony. Seating arrangements as per the Minister in Charge @MamataOfficialโ€™s whim.โ€

In another tweet, he said โ€œCompartmentalโ€™ CM @MamataOfficial still has nightmares about โ€œNandigram 1956โ€ so sheโ€™s doing this out of jealousy. Instead of the Bangla Academy Award for โ€œrelentless literary pursuitโ€ she should have been given โ€œVengeful Award for relentless pursuit to demean Constitutional Normsโ€.โ€

Suvendu went on to say โ€œSheโ€™s the most wretched politician ever born in India, who disgracefully latched on to power by becoming a โ€œPortfolio-lessโ€ Central Minister. If sheโ€™s elated that her 3rd rate tactics would rattle me then sheโ€™s living in a foolโ€™s paradise. Unlike her, I am conscious of my dignity.โ€
However, he congratulated Dr CV Ananda Bose for taking oath as the governor and sought an appointment from him.

In another tweet, he said โ€œHeartiest Congratulations to Dr CV Ananda Bose as he takes oath as the Governor of West Bengal. Iโ€™ve requested the Honโ€™ble Governor to kindly give me an appointment separately at any time according to his convenience. Itโ€™s fine even if he asks me to visit today.โ€

โ€œBeing the Leader of the Opposition, I am the representative of the people of WB. So itโ€™s my duty to apprise the Constitutional Head of the State about the various issues that have plagued our State; such as unabated Corruption, deteriorating Law & Order and Financial Insolvencyโ€, he stated in yet another tweet.
