Bombay High Court Granted Aryan Khan’s Bail

Mumbai : On Thursday, The Bombay High Court granted bail to Aryan Khan. Aryan Khan was arrested in Drugs on Cruise case. Along with Aryan Khan Arbaz Merchant and Munmun Damecha too have got bail. The bail was granted in plea against rejection of their bail applications by special NDPS court in the cruise ship drug bust case. The copy of order will be released either on Friday or Saturday. All three will be coming out of jail only after operative part of the order comes tomorrow.

The Bombay High Court has stated that Aryan Khan has to report at NCB office every Friday. He cannot leave the city. Evidence submitted should stay as they are, no tampering is permitted to be made with the evidences. The Bombay High Ccourt will read the detailed bail order with reasons tomorrow.

High Ccourt says that there are no grounds to keep Aryan Khan in Jail. The lower Court has repeatedly rejected the bail plea.

Aryan Khan was in NCB Custody fro last 26 days. NCB lost argument on further Custody.

Aryan’s lawyer in the court said, “Violation of constitutional rights to use retracted statement to deny bail.” Aryan Khan’s lawyer Mukul Rohatgi argued in the Bombay High Court that it is a violation of constitutional rights to use retracted statements at the time of the bail hearing.

“How can it be that what cannot be used during the trial can be used to deny me bail right now?” he said.

Aryan Khan’s lawyer has also argued that the NCB cannot “lump together” all the different amounts of drugs found and then say that “commercial quantity” has been recovered.

On the conspiracy allegation, Aryan Khan’s lawyer Mukul Rohatgi said, “What conspiracy? There have to be calls between them. Conspiracy is a meeting of minds. There has to be evidence.”

Aryan Khan’s lawyer Mukul Rohatgi said in response to the NCB’s arguments, “There is no possession. We [Aryan and Arbaaz] were together but I did not know what he was carrying.”

ASG Anil Singh argued, “Conspiracy is difficult to prove. Only conspirators know how they have conspired.”

After one and a half hours, the NCB has completed it arguments in court.

ASG Anil Singh said there is a “chance of tampering with evidence”, referring to witness Prabhakar Sail’s affidavit.

ASG Anil Singh, arguing for the NCB, said in the Bombay High Court, “My submission is three-fold. Aryan Khan was found in conscious possession. Two, he was connected with drug peddlers. And three, the arrest is valid.”
