Opinion | The Danger Behind The Bill To Remove PM, CMs Detained For 30 Days

The three proposed Bills that seek the automatic disqualification (or “automatic cessation”) of ministers, including the Prime Minister, if they remain in jail for 30 consecutive days on serious charges, in my view, are a direct threat to democratic values.

In today’s political climate, opposition leaders are often arrested by central agencies like the Enforcement Directorate at the drop of a hat. ED custody typically extends beyond 60 to 90 days. Now imagine what happens if an elected Chief Minister is arrested under such circumstances.

After 30 days in custody, the CM will be forced to resign. The cabinet will automatically dissolve. The assembly will then need to elect a new CM, triggering intense political instability. During this phase, political party controlling central agencies can pressure or threaten legislators with ED, IT, or CBI cases. The notorious “washing machine” effect will take over, where the accused conveniently turn clean once they switch sides.

The result is predictable. The state ruling party collapses, the opposition seizes control through coercion, and democracy becomes a casualty. The Finance Ministry informed Parliament that 193 cases were registered against politicians by the Enforcement Directorate in the past 10 years and only two have resulted in convictions.) the damage is already done. The elected government is gone, the mandate nullified, and the state ruled by a backdoor regime propped up by central power.

This is not reform. It is the slow dismantling of the democratic framework, where the ballot is replaced by the baton, and the will of the people by the will of power.
