CD Presented as Evidence Against Rahul Gandhi During Court Hearing Found Blank

During a hearing in a defamation case against LoP Rahul Gandhi, a CD submitted as key evidence was found blank when played before a Special Court in Pune.

Rahul Gandhi is facing trial for allegedly defaming Vinayak Damodar Savarkar during a speech made in London. The complaint was filed by Savarkar’s grandnephew, Satyaki Savarkar, who claims that Rahul Gandhi made derogatory remarks against Savarkar.

A sealed CD containing a recording of Rahul Gandhi’s alleged speech was submitted before the court. However, when the CD was played during the proceedings, the court discovered that it contained no data.

Advocate Sangram Kolhatkar, appearing for the complainant, noted that the CD had previously been viewed by the court, which had formed the basis for the issuing process against Rahul Gandhi. Kolhatkar then requested the court to directly view Rahul Gandhi’s speech available on YouTube.

However, Magistrate Amol Shinde rejected the request, stating that a “URL is not admissible in evidence” under Section 65-B of the Indian Evidence Act.

Following this, the complainant’s advocate produced two additional CDs and urged the court to inspect them in open court. The magistrate dismissed the application, after which Kolhatkar sought an adjournment. The matter has now been listed for further hearing.
