New Delhi | CPI(M) General Secretary Sitaram Yechury on Thursday has opened up has hit out at the Centre for keeping fellow party member under “de facto” arrest.
On August 28, a bench of Chief Justice Ranjan Gogoi and Justice S. A. Bobde and Justice S. Abdul Nazeer had allowed Yechury to go to Kashmir and meet Tarigami.
He was allowed to “only visit Tarigami and come back”.
The court had, also asked Yechury to submit a report on his visit to the state.
Sitaram Yechury submitted his report on Thursday and later hit out the Centre for making an “illegal” arrest of Tarigami asa there are no charges against him.
“In today’s hearing, relying upon our affidavit filed before theSupreme Court, it was also pointed out that the house arrest of Tarigami was on the face of it illegal as there were no charges against him, no order or detention has been issued, which authorizes his detention”, he wrote.
Yechury had filed a habeas corpus petition challenging the detention of Tarigami in the wake of the abrogation of Article 370 on August 5. The plea also stated that Tarigami was not in good health and Yechury wanted to meet him.
“In fact, his security has been given oral instructions to keep him in de facto house arrest, unsupported by any authority of law. Thereafter, Supreme Court has also issued a notice to the government of India on the points raised in the affidavit in the Habeas Corpus writ”, he added.
Yechury claimed that the police officer told him that no charges have been pressed against Tarigami and he has not been detained, rather he is free.
Tarigami in the presence of this officer indicated that the security vehicles of his Z plus security have been withdrawn, and that “although no detention order had been shown to him, his security has been asked not to allow anyone to go outside or come inside the house.”
The Supreme Court has asked the government to reply on this.
The top court on Thursday also ordered to shift ailing CPI-M leader Mohammed Yousuf Tarigami to the All India Institute of Medical Science (AIIMS), saying that his health is top priority.
On August 5 after the Centre revoked Article 370 from Kashmir, they immediately put the state on a lockdown, restricting all movement and cut down the communications.
