DG Home Guards Param Bir Singh, who was removed as Mumbai Police Chief, in a scathing letter leveled corruption charges against Anil Deshmukh and had sought a CBI inquiry through a plea before the High Court.
The Bombay High Court today refused to grant interim relief to former Maharashtra Home Minister Anil Deshmukh on the grounds that it hadn’t heard the respondent (CBI) yet. The CBI registered a case against him in connection with the allegations of corruption and malpractices made against him by former Mumbai Police Commissioner Param Bir Singh. He had moved the Bombay HC seeking quashing of the FIR registered by the central agency.
A bench of Justices SS Shinde and Manish Pitale adjourned the matter after the central agency sought 4 weeks to file its response to the plea. The Court told Deshmukh that he can approach the vacation bench with 48-hour notice to respondent CBI in case of extreme urgency.
“The petitioner has the liberty to move before the vacation bench with 48-hour prior notice to the other side in case of extreme urgency,” the High Court said.
When the plea came up for hearing on Thursday, Additional Solicitor General Anil Singh appearing for the central agency sought time to take instructions in the matter. He said that since CBI had been served with a copy of the petition only last evening, he needed some time.
Senior Counsel Amit Desai for Anil Deshmukh argued that at this stage, his client was merely seeking interim relief from coercive action.

The Court categorically stated that it cannot grant interim relief without hearing the respondent, which was the CBI in this case.

Based on such inquiry, a cognizable offense was discovered by CBI which proceeded to register FIR against Anil Deshmukh, reported Bar and Bench
The Maharashtra government has also approached the court with a plea raising specific objection against two unnumbered paragraphs of the CBI’s FIR and sought quashing of the same.
