New Delhi | The Central government on Friday will reintroduce the controversial Triple Talaq bill in Rajya Sabha after a failed attempt last year.
The Union cabinet on Thursday made amendments to the triple talaq law, officially called Muslim Women (Protection of Rights on Marriage) Bill 2017, to dilute two contentious provisions. Last year the government succeed in passing the bill from the Lok Sabha, however, the bill got stuck in the Rajya Sabha as the BJP led NDA is in the minority.
The amendments include that the only a woman, or a close relative can file a police case against her husband for instant triple talaq. She can drop the case if the husband comes around later and they arrive at a compromise. The third amendment stats that the magistrate can decide on releasing the husband on bail only after hearing the wife.
However, the cabinet didn’t change the provision of the Three-year penalty for the husband and the provision that only empowers a magistrate, and not a local police officer, to release the accused on bail.
The government hopes that it will get support from the non-NDA parties for the bill after the changes made. BJP has already issued a whip to its members to be present in the upper house.
The Supreme Court on 22 August 2017 in its verdict, termed the Islamic practice of Triple Talaq unconstitutional
