No Bail For Mohammed Zubair, Sent To 14-Days Judicial Custody

Co-Founder of Alt News Mohammed Zubair was denied bail by a Delhi Court today. The journalist was recently picked by Delhi Police for allegedly hurting religious sentiments and promoting enmity through his tweet made in 2018.

At around 7 PM, Chief Metropolitan Magistrate of Patiala House Court Snigdha Sarvaria pronounced the order. Zubair was remanded 14-day judicial custody.

Hours before the court pronounced its order, certain media outlets had reported that the bail has been denied to him. However, Zubairโ€™s lawyer Advocate Soutik Banerjee raised an objection that the Delhi Police had leaked the order to the media before it was actually pronounced by the Court.

Later, Delhi Police DCP KPS Malhotra clarified that he informed media incorrectly about the bail order.

After expiry of his 4-day police custody, Zubair was produced before the Patiala House Court.

While seeking 14-day Judicial Custody for Zubair, Special Public Prosecutor Atul Srivastava appearing for Delhi Police had informed the the Court that charges under Section 120B (criminal conspiracy) and 201 (causing disappearance of evidence of offence) of Indian Penal Code and Section 35 of Foreign Contribution (Regulation) Act have been added against Zubair. According to reports, the Police has alleged that Zubair received donations from Pakistan and Syria and thus, the matter requires further investigation.

A report by a US government commission โ€“ the Commission on International Religious Freedom (USCIRF) โ€“ on religious freedom in India was termed as โ€œbiased and inaccurateโ€ by the South Asian country. Calling it a โ€œmotivated agendaโ€, India accused that the report lacked understanding of the countryโ€™s plurality.

Ministry of External Affairs spokesperson Arindam Bagchi, reacting to the report, said: โ€œWe have seen the biased and inaccurate comments on India by the US Commission on International Religious Freedom (USCIRF). These comments reflect a severe lack of understanding of India and its constitutional framework, its plurality and its democratic ethos.โ€

โ€œRegrettably, USCIRF continues to misrepresent facts time and again in its statements and reports in pursuance of its motivated agenda. Such actions only serve to strengthen concerns about the credibility and objectivity of the organization,โ€ Mr Bagchi added.

The report in question was released by the CIRF in June. The report recommended  the Biden Administration to designate India, China, Pakistan, Afghanistan and 11 other nations as โ€œcountries of particular concernโ€ in the context of religious freedom.

USCIRF Commissioner Anurima Bhargava, during a special virtual congressional briefing,  had alleged that Indian government officials were tolerating and engaging in religious persecution of Muslims and Christians with prolific mob violence.
