New Delhi| Before the Maharashtra Assembly elections, the Chief Minister of the state and senior BJP leader Devendra Fadnavis received a major blow from the Supreme Court. The plea, which accused Fadnavis of concealing information in the election affidavit, was heard in the Supreme Court on Tuesday. The apex court has ordered the trial court to continue hearing the case. Earlier the Bombay High Court had given a clean chit to him.
The trial will be conducted in the Magistrate Court. The Supreme Court has ruled on the petition filed against Maharashtra Chief Minister Devendra Fadnavis. The Supreme Court had to decide whether to allow legal action against Fadnavis for concealing information about criminal cases in his 2014 election affidavit.
What is the charge on CM Fadnavis?
Fadnavis is accused of hiding the information of two criminal cases in the 2014 election affidavit. Both these cases are from Nagpur. One of them is defamation and the other is a fraud. Lawyer Satish Uke had filed a petition in the Supreme Court alleging that while filing the 2014 election nomination, Fadnavis had filed a false affidavit. However, earlier the Bombay High Court had dismissed the petition and said that the petition lacked facts.
According to the petitioner, two cases were registered against Fadnavis in various charges in 1996 and 1998. This is a clear violation of Section 125-A of the Representation of the People Act, 1951.
