BJP To Seek Breach of Privilege Action Against Mahua Moitra For Her Comment on Ex-CJI In Lok Sabha

During the discussion of Motion of Thanks to the President’s address in the Lok Sabha, Mahua Moitra made hit out at former Chief Justice of India.

 

New Delhi| Accusing the government of ‘defining cowardice as courage’, TMC MP Mahua Moitra on Monday tore into the Modi govt policies and decisions. She said that passing of the Citizenship Amendment Act (CAA), the state of the economy, passing farm laws on the strength of majority are all examples of this. She lashed out at the government saying that it has turned “hate and bigotry” into a cottage industry and said that the media and judiciary have failed to protect democracy.

During the discussion of Motion of Thanks to the President’s address in the Lok Sabha, Mahua Moitra made hit out at former Chief Justice of India. She referred to the Sexual harassment complaint against the former CJI and said, “The sacred cow that was the judiciary is no longer sacred.” Her comments led to an uproar with several members of the ruling party taking objection to it. The comments have now been expunged from the records.

Breach of Privilege Motion Against Mahua Moitra

Now the government is preparing to take action against Moitra. Reportedly, the government may bring a motion for breach of privilege against Mahua Moitra in Parliament. According to Article 121 of the Constitution, a judge of the Supreme Court or a High Court, who has given a decision, cannot be discussed in the Parliament.

The Rules and Procedure 352 (5) of Parliament also decide that the conduct of people sitting on constitutional posts cannot be questioned. Despite being directed by the Speaker in the House, Moitra repeated her statements in violation of Rule 356. In her speech during the discussion on the motion of thanks to the President’s address, she took a jibe at the government, the judiciary and the media.

Parliamentary Affairs Minister objected

Arjun Ram Meghwal, Minister of State for Parliamentary Affairs, objected to her remarks and said that such statements cannot be made. At the same time, BJP MP Nishikant Dubey objected to this, citing the rules. On this, the presiding chairman NK Premachandran said that if anything offensive is found in the comments by Mahua Moitra, then it will not be kept on record.

Mahua Moitra Commented on CAA and Economy

Targeting the government, the Trinamool Congress member said that some people call the power, bigotry and hate as courage. The MP said that this government unilaterally worked to enact the Citizenship Amendment Act but could not notify its rules even after a long time. Referring to the economy, she alleged that in the year 2020, India was the worst-performing country. She claimed that the economy will not grow for two years.

Referring to the three disputed agricultural laws, Moitra said that the government brought agricultural laws, while the opposition and farmer organizations were calling them anti-farmer. She said that they were brought without consensus and without review and were brought on the brute strength of majority.
