Manickam Tagore moves adjournment motion notice in LS, on Lakhimpur Violence

New Delhi: Congress MP Manickam Tagore on Monday gave an adjournment motion notice in Lok Sabha, on the Lakhimpur Kheri case. He also demanded “immediate resignation of MoS Home Ajay Kumar Teni.” The opposition has also demanded the resignation of Teni, amid the Lakhimpur incident.

The court will hear today the bail plea of Union Minister for Home Ajay Mishra’s son, Ashish Mishra, who is the main accused in the Lakhimpur violence case. Last Friday, the court had rejected the second bail application of Ashish Mishra. After which, on Saturday, a bail application was filed on behalf of Ashish Mishra in the district judge’s court, on which the court will hear today.

The bail application was moved on Saturday, under modified sections of the Indian Penal Code (IPC) in connection with FIR number 219 before the court of the district and sessions judge here. FIR number 219 pertains to the killing of four farmers and a local journalist during the October 3 violence in Lakhimpur Kheri where a total of eight people were killed on the day.

The development came after the court of chief judicial magistrate (CJM) on Friday rejected Ashish Mishra’s previous bail application under sections 307, 326 of IPC and sections 3/25/30 read with section 35 of Arms act.

The Special Investigation Team probing the case had recently removed the sections of culpable homicide against 13 accused involved in the case, including Ashish Mishra, and added the charges of murder under a well-thought-out conspiracy on the orders of the court. While hearing the application of the investigating officer, the court had made the remand of 13 accused including Ashish Mishra under new sections.

After this hearing of the court, all the accused including Ashish Mishra were sent to judicial custody under several sections including murder under conspiracy and misuse of a licensed gun. At the same time, while hearing the bail application on Friday, the court said that the case is of a cognizable offense, in which bail does not appear to be eligible. After which the court rejected the bail application of Ashish Mishra.

Four farmers were allegedly crushed by an SUV car at Tikunia in Lakhimpur Kheri on October 3, when they were returning from an event protesting against agricultural laws. Deputy Chief Minister Keshav Maurya and Union Minister Ajay Mishra Teni were present in the program. The farmers allege that the SUV belonged to Ajay Mishra Teni and his son Ashish Mishra was in it. Ashish Mishra has been arrested and the farmers are now demanding the dismissal of the Union Minister as he is also an accused in the case.
