Narada Case: Calcutta HC Orders House Arrest Of 4 TMC Leaders; Refers Matter To Larger Bench

A Division Bench of Acting Chief Justice Rajesh Bindal and Justice Arjit Banerjee differed in their opinion regarding the matter. While Justice Banerjee was in favor of granting interim bail, the Acting Chief Justice differed.

The Calcutta High Court on Friday ordered the house arrest of four Trinamool Congress (TMC) leaders accused in the Narada bribery case and also referred the matter to a larger bench after a split verdict.

The Division Bench of Acting Chief Justice Rajesh Bindal and Justice Arjit Banerjee differed in their opinion regarding the matter. While Justice Banerjee was in favor of granting interim bail, the Acting Chief Justice differed on the matter.

So we referred to larger Bench on that while thinking that meanwhile, they can be in house arrest since pandemic is there”, the Court informed, reported Bar&Bench

“Meanwhile, the four accused will be under house arrest with all necessary medical assistance. They will be able to work virtually but cannot meet anyone,” Niladri Bhattacharya, the lawyer for Madan Mitra, said.

The house arrest of 4 TMC leaders – State ministers Subrata Mukherjee, Firhad Hakim, TMC MLA Madan Mitra, and former Kolkata Mayor Sovan Chatterjee will be in line with the terms outlined by the Supreme Court earlier for the house arrest of Gautam Navlakha in the Bhima Koregaon case.

This decision was opposed by the Central Bureau of Investigation (CBI) through Solicitor General Tushar Mehta, who urged the Court for a stay so that the agency may file an appeal before the Supreme Court.

The counsel for TMC leaders, Senior Advocates Dr. Abhishek Manu Singhvi, Sidharth Luthra, and Kalyan Bandhopadhyay agreed with the Court’s decision to constitute a larger Bench but requested that the same be done at the earliest.
