Petition filed in Supreme Court against 10 percent reservation bill for economically weaker section

New Delhi | A day after being passed from the parliament, the Constitution (103rd Amendment) Bill, 2019 is been challenged in the Supreme Court.

An NGO ‘Youth for Equality’ has filed a petition in the Supreme Court challenging the Constitution Amendment Bill, 2019 which provides 10% reservation to the economically weaker sections claiming that the amendment violates the basic Structure of the Constitution. The petition stated that economic criteria cannot be the sole basis for reservations under the Constitution. It further added that economic reservation if brought in cannot be limited to general category.

The Rajya Sabha on Wednesday passed the Constitution (124 Amendment) Bill, 2019 which will provide reservation for economically weaker section of the society in higher educational institutions. 165 member of the Upper house voted in favour of the bill while 7 member voted against the proposed bill. Earlier on Tuesday, the Lok Sabha passed the Constitution (124 Amendment) Bill, 2019. Out of the 326 member present for voting, 323 members voted in favour of the bill while only 3 members voted in opposition to the bill.

In a major move ahead of the 2019 Lok Sabha polls, the Union Cabinet on December 7 cleared a 10 percent job and education quota for “economically weaker” sections of upper castes. The proposed reservation will be over and above the existing 50 percent reservation enjoyed by the Scheduled Castes, Scheduled Tribes and the Other Backward Classes, taking the total reservation to 60 percent.
