New Delhi| As the Rajasthan High Court is scheduled to pass orders tomorrow on the petition filed Sachin Pilot and group of rebel MLAs against disqualification notices issued by Rajasthan assembly speaker, the Supreme Court on Thursday heard the Speaker’s challenge against HC direction to extend the time for filing replies by the rebel Congress MLAs.
Observing that “serious questions related to democracy” are involved in the matter, a bench headed by Justice Arun Mishra said that the Special Leave Petition filed by the Speaker, C P Joshi, will be heard on Monday.
However, the SC bench refused to accept the plea made by Senior Advocate Kapil Sibal, who on behalf of the speaker demanded to stay the HC proceedings that it will clarify that the HC judgment will be subject to SC orders

Earlier, while hearing Kapil Sibal, Justice Arun Mishra orally observed that voice of dissent within the party cannot be suppressed.
While representing Sachin Pilot earlier in Rajasthan HC, his lawyer Mukul Rohatgi said that the assembly speaker gave the legislators only 3 days to respond, while 7 days should have been given. “Why were they in such a hurry? The defection law was enacted so that no party could change,” he said.
During the hearing on Monday in the Rajasthan High court, Abhishek Manu Singhvi made the arguments on behalf of the speaker CP Joshi. Singhvi said that the speaker has sent just a notice to the MLAs, they were not disqualified. He said that the petition of the pilot camp is pre-mature and it should be rejected.
