Send Migrants Home In 15 Days, Withdraw Cases Against Them: Supreme Court

The Supreme Court also directed the Centre to provide additional trains to send the migrants to their homes within 24 hours if the state demands it.

 

New Delhi| The Supreme Court on Tuesday ordered the migrant labourers trapped in different states due to the lockdown. The apex court said that migrant labourers should be sent to their homes in 15 days. The court also said that consider withdrawing all the cases registered under the Disaster Management Act for breaking the lockdown rule against them. It asked the central and state governments to prepare a list for identifying migrant labourers and mapping to identify their skills.

A bench of Justices Ashok Bhushan, Sanjay Kishan Kaul and MR Shah held the hearing. The court also directed the Centre to provide additional trains to send the migrants to their homes within 24 hours if the state demands it. Now the next hearing, in this case, will be held in July.

On May 28, the Supreme Court gave an interim order on the migration of migrant labourers. The court said that no fare should be charged from migrant labourers travelling by trains and buses. State governments should bear this expense. The court ordered that the state governments should also make arrangements to provide food to the trapped labourers.

FOUR POINT ORDER BY SUPREME COURT

1. Supreme Court said that no fare should be taken from migrant labourers travelling by train and bus. State and Union Territory Governments should bear this expenditure.
2. State governments should provide food and water at the stations and the railways should make this arrangement for labourers within trains. Food and water should also be given to them on buses.
3. The state governments should also provide food for the trapped labourers who are waiting for buses and trains to go to their homes all over the country. Where will the workers get food and where will the registration be done should be informed.
4. The state government should look into the process of registration of migrant labourers and also ensure that they get a train or bus as soon as possible to travel home. All information related to this matter should be given to the people.

The Supreme Court had said that the condition of the labourers is bad. The arrangements made by the government for them are insufficient. The court had issued notice to the central and state governments in the matter and sought its response by May 28.
