Supreme Court ready to take up the Kathua rape case voluntarily

While still as the entire nation has been left in a state of shock and disgust at the gang-rape and murder of an eight-year-old in Kashmir, the Supreme Court today stated that it will voluntarily, examine the rape incident of Kathua, proviso the advocates present the facts and details of the case to the case in writing.

The Supreme Court wants it to be stated in writing that the lawyers in the district of Kathua, Jammu and Kashmir, exerted to avert the filing of a chargesheet against the accused of rape. The top court also wants it to be stated that these lawyers threatened the ones who are representing the family of the eight-year-old.

In Delhi, a group of lawyers who practice in the Supreme Court have made a request to Justice Dipak Misra, the Chief Justice of India, and Justices D Y Chandrachud and Justice A M Khanwilkar to take suo moto understanding of the horrendous incident. The lawyers stated that they would mention the facts of the case in writing for the Supreme Court.

On Monday, in Kashmir, a group of furious lawyers from one community averted the crime branch of Jammu and Kashmir police from filing a chargesheet against the seven people accused in the rape and murder of eight-year-old Asifa in the district of Kathua.

It was on Monday that as soon as the accused along with the Special Investigation Team (SIT) of crime branch reached the court complex of Kathua at around 4:15 pm, that the lawyers started to protest. A police contingent attempted to make way for the team of crime branch for entering the court complex in vain as the rigorous protests were staged by the lawyers.

On the other hand, SP Vaid, director general of police of Jammu and Kashmir stated that nothing could be worse than this crime. He said, ā€œIt is a very heinous crime, it can’t get worse than this. The SIT has done a very professional job and filed chargesheet, now we hope justice will be doneā€.

The eight-year-oldā€™s body was recovered from the forest of Rassana on 17 January, a week after she went missing while grazing the horses in the spot. The state government has handed the case over to the crime branch following statewide protests.

All the accused, that include the mastermind Sanji Ramthe, his son Vishal, two Special Police Officers Deepak Khajuria and Surender Verma, sub-inspector Anand Dutta, head constable Tilak Raj and civilian Parvesh Kumar, were booked under the Sections 302 (murder), 376 (rape) and 120-B (criminal conspiracy) of Ranbir Penal Code.
