Muslim Teen Granted Bail After Accuser Denies ‘Spitting’ Charge

Monday saw the granting of bail to a Mumbai teenager who was detained as a minor almost five months prior for allegedly spitting during the Mahakal Sawarti procession in Ujjain last year. Adnan Mansoori (18) was granted bail by the Madhya Pradesh High Court’s Indore bench after the main complainant said he had not witnessed any “spitting” during the parade and that he had signed his section of the FIR “under pressure from the police.”

Furthermore, the judgement stated that although Sawant Lot, the complainant, had been interrogated by a trial court, he had “turned hostile and did not support the case of the prosecution.”

“Eyewitness Ajay Khatri also turned hostile and did not support the case of the prosecution,” Justice Anil Verma said.

The court noted, without commenting on the merits of the case, “It is directed that the applicant be released on bail upon his furnishing a personal bond in the sum of Rs 75,000 with one solvent surety in the like amount to the satisfaction of the trial court for his appearance before the trial court, as and when required. He shall abide by the conditions enumerated under section 437(3) CrPC.”
