Special Supreme Court Session On Calcutta HC Judges’ Conflict

The Supreme Court is scheduled to address the dispute between a single-judge bench and a division bench in the Calcutta High Court regarding a fake caste certificate issue in West Bengal. Chief Justice DY Chandrachud leads a five-judge bench that includes Justices Sanjiv Khanna, BR Gavai, Surya Kant, and Aniruddha Bose. The case, titled “In Re: Orders of Calcutta High Court dated January 24, 2024, and January 25 and Ancillary Issues,” stems from conflicting orders issued by the Calcutta High Court’s single-judge bench and division bench.

Justice Abhijit Gangopadhyay, in his order, accuses Justice Soumen Sen, who heads the division bench, of acting in favour of a political party in West Bengal. Justice Gangopadhyay directed disregarding the division bench’s order and urged the CBI to investigate the fake caste certificate matter.

Alleging that Justice Sen is supporting a political party in West Bengal, Justice Gangopadhyay asserts that the Supreme Court should reconsider the orders issued by the bench led by Justice Sen if it deems it necessary. He contends that Justice Sen’s actions amount to misconduct and were undertaken to protect a political party in power.

The case originated from a petition in the High Court claiming the widespread issuance of fake caste certificates to facilitate admission to medical courses. On January 24, Justice Gangopadhyay instructed the West Bengal Police to provide relevant documents to the CBI. Subsequently, the matter was brought before a division bench, which temporarily halted the single judge’s order.

Despite the division bench’s disagreement with the single-judge decision, Justice Gangopadhyay revisited the matter on January 25, making certain remarks against Justice Sen. The Supreme Court’s special sitting is anticipated to bring clarity and resolution to the conflicting orders from the Calcutta High Court.
