Big Relief For Team Thackeray In Sena Vs Sena Battle

The apex Court is likely to take a call on Monday on whether the matter needs to be referred to a constitution bench.

New Delhi: In a big relief to former Maharashtra Chief Minister Uddhav Thackeray,  in the fight over control of the Shiv Sena, the Supreme Court today directed the Election Commission of India not to decide on a plea by rival  Eknath Shinde, the Maharashtra Chief Minister, to recognize his faction as the real Shiv Sena.

The apex Court is likely to take a call on Monday on whether the matter needs to be referred to a constitution bench.

Claiming that he commands the numbers – and, therefore, the Sena  the Maharashtra CM had submitted that courts shouldn’t interfere with internal party decisions “taken democratically by the majority.”

Senior Advocates Kapil Sibal and Dr. Abhishek Manu Singhvi represent the Thackeray faction. Senior Advocates Harish Salve, Neeraj Kishan Kaul, and Mahesh Jethmalani are appearing for the Shinde group. Solicitor General of India Tushar Mehta is appearing for the Maharashtra Governor.
