Lawyers On Strike, Boycott Hearings In Gujarat & Telangana As HC Judges Transferred To Patna

New Delhi: The Supreme Court collegium decided to transfer Gujarat and Telangana High Court Judges to Patna. This decision has upset the lawyers in both places. Lawyers of the Gujarat High Court have gone on an indefinite strike since Thursday. Lawyers of the Telangana High Court have decided to boycott hearings.

Justice Nikhil Kariel from Gujarat HC and Justice A Abhishek Reddy from Telangana High Court has been transferred to the Patna HC.

The protesting lawyers of Telangana HC see no reason why Judge was being transferred. Lawyers said, “We saw no reason why a righteous judge was moved out, if not it’s part of a condemnable “design”. They didn’t explain what could be the design.”

On this, the Gujarat HC Bar said, “The transfer of the finest, honest, upright, and unbiased judge, Justice Kariel, strikes at the rule of law and independence of the judiciary, the two prime edifices on which our Constitution rests”.

The Gujarat High Court Advocates Association said that the “indefinite strike” of lawyers would be reviewed on November 21. They said so while deciding to send a delegation to the Chief Justice of India and other judges of the collegium, and four SC judges elevated from Gujarat HC.

After lawyers protested in the state, Gujarat High Court Chief Justice Arvind Kumar held a meeting with senior lawyers. After the meeting, the association resolved the strike.

The association’s resolution read as, “There shall be protest and strong opposition against such steps and the members of the bar will protest indefinitely till the issue is resolved…”

GHAA was supposed to conduct an election on November 18 to elect its president. But GHAA has postponed the elections and is protesting at High Court Gates since morning.

Previously, in November 2018, GHAA members voted against the SC collegium’s suggestion to transfer Justice Akil Kureshi to the Bombay High Court. It also opposed the transfer and promotion policy when Justice Jayant Patel was transferred from Karnataka High Court to Allahabad High Court a year ago.
