Mumbai : Aryan Khan’s bail application was rejected by the special court on October 20. Aryan Khan’s lawyer Amit Desai had told reporters outside the court that they now plan to move the Bombay High Court. The Bombay HC has given date of October 26 to hear Aryan Khan’s bail plea. In a significant development, former Attorney General of India (AGI) Mukul Rohatgi is expected to appear for Aryan Khan’s bail plea, scheduled to come up before the Bombay High Court on October 26.
Aryan Khan has been in Mumbai’s Arthur Road jail since October 8 and was briefly in the custody of the NCB before that. His lawyers have approached the Bombay High Court for bail.
Mukul had recently slammed Narcotics Control Bureau by terming it as “an Ostrich with head buried in the sand.” He will join Khan’s existing battery of lawyers in the HC during the day.
Apart from Mukul, on Khan’s side there are senior lawyers like Amit Desai and Satish Maneshinde who have fought for him in the Magistrate Court and Special NDPS Court, besides the HC.
Aryan Khan, his friend Arbaaz Merchant and model Munmun Dhamecha, and five others were arrested after disguised officers of the Narcotics Control Bureau (NCB) raided a rave party on a cruise ship off Mumbai on October 2. Since then, the number of arrests has gone up to 20.
On October 21 Shah Rukh Khan left to meet his son Aryan Khan who is in jail for drugs case. The 23 year old was detained during Narcotics Control Bureau raid on a Goa-bound cruise ship off the coast of Mumbai.
According to the jail authorities, today is visitor’s day. Shah Rukh was asked to show his identity card at the entry gate. He went inside and met his son as per the prison manual for 15-20 minutes. They spoke to each other via intercom due to the glass fencing inside the prison. During the meet, four guards were present.
The second bail plea order was reserved for seven days after the hearing took place on October 14. As per the court order, the reasons for not granting bail were listed as, “From WhatsApp chats of Applicant 1 (Aryan Khan), it is reflected that he was indulging in illicit drug activities. Respondent (ASG Anil Singh representing NCB) contended that since all the accused including applicant no. 1 (Aryan), are influential persons, they are likely to tamper with the evidence of prosecution if released on bail.”
Besides this, NCB has alleged Aryan of illicit international drug trafficking. “Respondent claimed that accused No. 1 (Aryan) is in touch with foreign nationals and other drug dealers who appear to be a part of international drug network and investigation in this regard is going on and respondent is tracing out the criminal antecedents of said persons. If any of the accused are released on bail, it will hamper the entire investigation,” read the court order.
He had spoken with his parents, SRK and Gauri Khan, on a video call on Friday.
