The petition of the former police commissioner of Mumbai Parambir Singh is being heard in the Bombay High Court. the plea seeks investigation in the recovery allegations against Maharashtra Home Minister Anil Deshmukh. Meanwhile, Parambir Singh’s lawyer Vikram Nanakani demanded to hand over the investigation to the CBI. Responding to the demand Bombay High Court Chief Justice Dipankar Dutta slammed Parambir Singh and schooled him on the correct way to approach the court. Justice Dutta said, “You want us to directly order an inquiry without consent? That too without any FIR.” “Tell us a case in which FIR has not been filed and that case has been transferred to CBI,” he added.
CJ Dutta also questioned Parambir Singh for not filing FIR in the case. “The petitioner is no layman, he knows the CrPC well. If he has no faith in the state, he can approach others. This petition in the absence of an FIR prima facie appears to be without substance,” he said.
“You are a police officer. If you find an offence has been committed you are duty, you are duty-bound to file an FIR. Why did you not do it?” Chief Justice Dutta asked.

Courtroom Exchange Between Parambir’s Lawyer and Judges
Chief Justice: We are looking at two things, in this case, is this PIL maintainable and can the court order any without an FIR. If you want any interim relief from us, then you have to satisfy us on these points.
Parambir’s lawyer: Nankani cited the report submitted to the Director-General of Police by former Commissioner of Intelligence Rashmi Shukla during the hearing. He also read the letter written by the DG to the Additional Home Secretary.
Nankani further said that the allegations have been levelled by the senior-most officer of Mumbai Police. The case should be entrusted to the CBI for a fair and independent investigation.
Advocate General: Advocate General of Maharashtra Ashutosh Kumbakoni said that such applications are not worth hearing. I will show you some judgment in this regard. We should follow the law in this regard. We want to clear the allegations which are discussed in the media.

He says that Officer Rashmi Shukla’s report on transfer-posting should be investigated. Parambir has also demanded an investigation of the CCTV footage of Deshmukh’s bungalow.
