“Jama Masjid Is Not Pakistan”: Judge’s Exasperated Remark On Hearing Bhim Army Chief Bail Plea

Judge Kamini Lau came down heavily on Delhi Police and Public Prosecutor while listening to Bhim Army Chief’s bail plea today.

DELHI| Tis Hazari Sessions Court gathered today to hear about Bhim Army Chief Azad’s bail plea where Judge Kamini Lau expressed her displeasure over the actions of Delhi Police.

Adv Mahmood Pracha appeared for Azad, who has been under custody since Dec 21 over alleged violence during CAA protests in Daryaganj.

Pracha pointed out that FIR filed against Azad has mentioned charges against Azad in UP. Judge asked the Prosecutor about those charges. Public Prosecutor pleaded ignorance and told that he will find out. The judge expressed surprise at the fact that the Public Prosecutor was not aware.
Prosecutor also mentioned some posts by Azad in social media. Pracha, Azad’s lawyer, asked about those posts. Prosecutor said he cannot share with him. The judge slammed the Prosecutor, “What privilege you are claiming?”
Prosecutor then read out a post by Azad about going to dharna in the Jama Masjid area. Judge Kamini Lau asked Public Prosecutor, “What is wrong with dharna? What is wrong with protesting? It is one’s constitutional right to protest.”

“Where is the violence? What is wrong with any of these posts? Who says you cannot protest..have you read the constitution?”Judge Kamini Lau continued asking the Public Prosecutor.
Judge Lau further said, “You are behaving as if Jama Masjid is Pakistan. Even if it was Pakistan, you can go there and protest. Pakistan was a part of undivided India. Judge refers to the posts of Azad and says “none of these are unconstitutional”.
Judge Lau said that it is the right of a citizen to protest. Prosecutor replied that permission needs to be taken.

Judge Lau added, “I have seen many people, many such cases, where protests happened even outside parliament.”

The judge adjourned hearing ordering Delhi Police to produce evidence against Azad soon.
