Law student who accused Chinmayanand of rape, arrested in extortion case

The SIT took the victim’s friends Vikram and Sachin in remand in connection with seeking Rs. 5 crores from Chinmayanand.

 

Lucknow| The former UP Minister Chinmayanand has been arrested by the police after a law student accused him of rape and sexual exploitation. However, days after his arrest, the law student has also been arrested by the Special Investigation Team in connection with the extortion case. The girl released a series of videos a few days ago and accused Chinmayananda of sexual exploitation.

In the extortion case, the girl and her three accomplices were booked by the police. Earlier, on Tuesday, the SIT took the victim’s friends Vikram and Sachin in remand in connection with seeking Rs. 5 crores from Swami Chinmayananda. The SIT has received a 95-hour remand from the court.

The complainant girl has also petitioned the court for anticipatory bail. The SIT is investigating the case on the orders of the Supreme Court. The SIT is yet to recover a missing mobile phone in the alleged rape case. On the basis of this, the SIT detained Vikram and Sachin, two friends of the complainant girl, on Tuesday. Both of them were arrested in the extortion case. The victim’s name is also included in this case.

 

What is the case?

On August 24 a video was put up on social media by a 23-year-old law student in UP’s Shahjahanpur. In the video, she accused former UP minister and BJP leader Chinmayananda of sexually harassing and raping her. She begged for help from PM modi and CM yogi adityanath. A day after the girl put up this video, she went missing. Her father named Chinmayanand and filed a complaint of sexual harassment and abduction.

The girl was later found in Rajasthan and a team of UP police brought her to Shahjahanpur almost 5 days after she went missing. By then media held the matter and it reached the supreme court and the apex court ordered an SIT investigation monitored by Allahabad high court. It was on September 9 that the victim spoke about her ordeal and the horrors she faced.

She said Chinmayanand raped her for almost 1 year. She said Chinamayanand along with his associates secretly filmed her when she was taking a bath and then used it to blackmail and harass her. He allegedly threatened to make the video viral and raped her multiple times. A video surfaced in which Chinmayanand is seen getting a massage from the girl.

The victim also submitted 43 video evidence against Chinmayanand which she claimed were incriminating. All this while she had been constantly claiming that Chinmayanand raped her and sexually exploited her. It was not until the victim threatened to burn herself that the wheels moved a little.
Almost a month later, he was arrested but not for rape. He had been charged under 354 D (stalking), 342 (wrongful confinement) and 506 (criminal intimidation) of the Indian Penal Code and Sections 376C (sexual intercourse by a person in authority) but not amounting to rape. The provision criminalises the abuse of position by a person in authority if he “induces or seduces” any woman to have sexual intercourse with him. However, It also adds that “such sexual intercourse not amounting to the offence of rape”, would be punishable with imprisonment of five to 10 years, and a fine.
