Prashant Bhushan Approaches SC To Postpone Sentence Hearing, Seeks 30 Days To File Review Petition

New Delhi| The Supreme Court had fixed today’s date to pronounce sentence of lawyer Prashant Bhushan in the contempt case. However, a day before his sentencing, Prashant Bhushan has approached the court saying that a hearing on the sentence should be postponed and he should be given a chance to file a review petition so that justice can be done.

Bhushan argued – scope for mistakes in human decisions

Prashant Bhushan’s lawyer Kamini Jaiswal approached the court on his behalf. Bhushan says that human decisions are not always infallible. Mistakes can still happen despite all attempts at a fair trial. In cases of criminal contempt, the Supreme Court acts like a trial court, and there is no alternative.

Bhushan has argued that a petitioner can further appeal/ challenge the High Court verdict in contempt cases in the Supreme Court. However, there is no option left after the Supreme Court verdict. Therefore, special care should be taken that justice is done. Bhushan has appealed for 30 days to file a review.

Prashant Bhushan Was Held Guilty of Contempt of Court

The Activist-lawyer was convicted of contempt by the Supreme Court on 14 August. In a suo motu contempt case against Prashant Bhushan over his two tweets on CJI Bobde and his four predecessors, the bench headed by Justice Arun Mishra heard the arguments. The punishment for contempt of court may include up to six months in jail, or fine, or both. Earlier, contempt of court notice to Advocate Bhushan, for his tweets critiquing the judiciary, was issued by the bench of the Supreme Court led by Justice Arun Mishra. The top court took note of Bhushan’s tweets as “bringing disrepute to the administration of justice.”
