Umar Khalid Gets Bail But Will Stay In Jail Under UAPA Charge

Additional Sessions Judge Vinod Yadav has directed Umar Khalid to install the Aarogya Setu app on his phone, as one of the bail conditions.

Activist and former JNU student leader Umar Khalid was granted bail on Thursday by a Delhi Court in connection with an FIR filed in the North-East Delhi riots case. Communal violence had broken out in northeast Delhi on February 24 last year leaving at least 53 people dead and around 200 injured. Suspended AAP councilor Tahir Hussain is also a prime accused in the case. Khalid, however, will continue to remain in jail under the stringent Unlawful Activities Prevention Act (UAPA) in another case related to a conspiracy in the riots. He has been in jail since October 2020.

The former JNU student leader was granted bail on his furnishing a personal bond of Rs 20,000 with one surety of the like amount. Upon his release, Additional Sessions Judge Vinod Yadav has directed Umar Khalid to install the Aarogya Setu app on his phone. Besides this, other bail conditions include no tampering of evidence and influence of witnesses. He was also directed to appear before the Court on each and every date of hearing and is also required to furnish his mobile number to SHO, PS Khajuri Khas upon his release, reported Bar & Bench

The applicant (Khalid) cannot be made to incarcerate in jail for infinity merely on account of the fact that other persons who were part of the riotous mob have to be identified and arrested in the matter.”

Karkardooma Court’S OBSERVATION

The Court further recorded that there was no CCTV footage/viral video of Khalid from the crime spot and no independent witness or police witness had identified him. The applicant cannot be permitted to remain behind bars in this case on the basis of such a sketchy material against him..” the Court noted.

Khalid argued that he was falsely implicated and sought bail on grounds of parity with other co-accused Khalid Saifi in the case.
