The bench ordered that the matter of the Hijab ban, be placed before the CJI for assigning the controversy, arising from the Karnataka government’s February 5 circular, to a three-judge bench.
Justice Hemant Gupta has upheld the Karnataka government circular enforcing uniforms and banning all religious dresses, including hijab. The Justice dismissed the appeals challenging the ban.
Justice Hemant Gupta, before announcing the judgment, said “There is divergent opinion”.
Justice Dhulia said, while differing from Justice Gupta, the primary consideration for him was the education of Muslim girl students.
