Relief For Ekanth Shindeโ€™s Shiv Sena, No Stay On ECIโ€™s Order Yet Says SC

The Shiv Sena name and symbol will remain with Maharashtra Chief Minister Eknath Shindeโ€™s Shiv Sena, and the โ€œmashaalโ€ or flaming torch symbol with Uddhav Thackeray for now, the Supreme Court said today, assuring the status quo on the issue that has been the bone of contention since the split of the party last year, reported NDTV. 

The SC said it cannot put a freeze on the Election Commissionโ€™s order โ€œat this stageโ€. The Thackeray camp can use legal challenges if any action is taken that is not based on the Election Commissionโ€™s order.

The court has agreed to hear the petition from Team Thackeray, which has challenged the Election Commissionโ€™s order handing the Shiv Sena name and its โ€œbow and arrowโ€ symbol to the Shinde faction.

Mr. Thackeray had sought the status quo till the matter is decided. Kapil Sibal, who was representing him in court, told a bench led by Chief Justice of India DY Chandrachud that they want protection.

โ€œWe want protection. We donโ€™t want our properties and bank accounts to be taken over,โ€ Mr. Sibal said, pointing out that the parliamentary office of the Shiv Sena was taken over by the Shinde faction yesterday.

Team Shinde has contended that the matter has already been heard and rejected by the High Court and the Election Commission allowed to go ahead and take a decision.

Why should the Udhav Thackeray group come to the Supreme Court directly, and why should the court intervene,  they questioned.

Shelly Oberoi, a former Delhi University professor, is a first-time councillor who won the Delhi civic body election from the East Patel Nagar ward. The 39-year-old has studied management from IIM, Kozhikode.

Shelly Oberoi has been associated with the Arvind Kejriwal-led party since 2014 and was named the vice president of the partyโ€™s Mahila Morcha (woman wing) in 2020.

Ms. Oberoi is a lifetime member of the Indian Commerce Association (ICA). She did her Ph.D. at Indira Gandhi National Open Universityโ€™s (IGNOU) School of Management Studies. She won several awards in different conferences.

โ€œThe members of Delhiโ€™s civic body appointed by the Lieutenant Governor cannot vote in the election to choose a mayorโ€. The Supreme Court had said earlier last week.

โ€œGoons have lost people have won.โ€ AAP national convenor Arvind Kejriwal said congratulating the newly elected mayor.
