The Court stated, “”There is no doubt that the remand application copy, which is supposed to communicate the grounds of arrest in writing, was not provided to the accused-appellant or his counsel before the remand order was passed on October 4, 2023. This oversight invalidates the arrest and the subsequent remand of the appellant. Therefore, the appellant should be released from custody, following the precedent set by the court in the Pankaj Bansal judgment,”” the Court declared.
