Setback for Arvind Kejriwal: There will be no freeze on the Centre’s executive order controlling the bureaucrats posted in Delhi, the Supreme Court said today in response to a petition by Delhi’s Aam Aadmi Party government, which had challenged the constitutional validity of the Centre’s order, reported NDTV. But the court has issued a notice to the Centre following the Delhi government’s petition. “We will issue notice to amend the petition to implead the Lieutenant Governor,” said Chief Justice of India DY Chandrachud. The next hearing is on Monday, when the court will also hear the Delhi government’s petition on the Lieutenant Governor sacking 400 specialists like fellows, research officers. Now what’s interesting is the ordinance was passed to overturn the apex court’s order which was passed earlier in May. In a unanimous verdict, the Supreme Court had ruled that the Delhi government has legislative and executive powers over services except for public order, police, and land. Asserting that an elected government needs to have control over the administration, a five-judge constitution bench, headed by chief justice D Y Chandrachud, said the Union Territory of Delhi has a unique character” and refused to agree with the 2019 judgment of Justice Ashok Bhushan that the Delhi government has no power over the issue of services. The CM of Delhi was touring around the country last month in a bid to seek support from various political parties of the opposition to vote against the ordinance in the upper house. Apart from the grand old party, most opposition parties have promised to support the AAP and vote against the ordinance. However, it would all go in vain, because the Congress is the largest Opposition party in the Upper House with 31 members of Parliament. Defeating the Bill without the support of Congress is almost impossible as the BJP-led NDA has the support of 109 MPs in the Rajya Sabha out of the current strength of 238 of the Upper House. Now Congress considers AAP as its competitor in Delhi and Punjab where Congress is a strong player.
