“Can’t Prevent Anything From Happening, Have Limitations To Our Powers”: CJI Bobde

CJI Bobde added that courts cannot prevent anything from happening and only come into picture after incidents have occurred.

 

New Delhi| The Supreme Court today agreed to take up the plea related to Delhi violence for hearing on Wednesday. The plea was filed by Activist Harsh Mander seeking FIR against BJP leaders for their alleged incendiary statements ahead of the widespread riots that rocked North-east Delhi last weekend.

However, while taking up the case Chief Justice of India SA Bobde made an observation that the powers of the courts have certain limitations. “There are reports that suggest as if courts are responsible for everything. We wish peace but there are certain limitations to our powers too,” CJI Bobde said. He added that courts cannot prevent anything from happening and only come into picture after incidents have occurred.

Last week a Delhi high court bench headed by Chief Justice DN Patel and Justice C. Hari Shankar had deferred the petition seeking FIR against BJP leaders. They listed the next hearing date on April 13. The court order to defer the hearing came after Justice Muralidhar, who was the third senior-most justice in the Delhi High Court had pulled up the Delhi Government for their inaction during the riots.

Activist Harsh Mander had sought filing of FIRs against Union Minister Anurag Thakur who had led the “Goli Maaro” chant ahead of the Delhi elections, BJP leader Kapil Mishra who had issued an ultimatum and BJP MP Parvesh Verma for their incendiary speeches.

The riots that ravaged parts of North-East Delhi left as many as 44 people dead and hundreds injured.
