Union government passes an ordinance on Triple Talaq; makes it a punishable offence

New Dehli | The Narendra Modi cabinet on Wednesday passed an ordinance stating the practice of Triple Talaq a punishable offence under the law.

The ordinance will have the similar provision to the Triple Talaq bill passed by the government in the Lok Sabha during the last years winter session. The government had earlier failed to clear the bill from the Rajya Sabha. During the debate over the bill in the Rajya Sabha, various opposition leader had argued that the bill must be sent to a Parliament’s Select Committee for close scrutiny.

According to the proposed bill, instant “triple talaq” has been made a criminal offence and a three-year jail term is proposed for a Muslim man who divorces his wife through this practice. The bill covers all kind of instant triple talaq illegal whether delivered orally through a telephone or a mobile call, or in writing or through an electronic medium like Whatsapp or SMS.

The Central government had formed a committee of a group of ministers including Finance Minister Arun Jaitley, Home Minister Rajnath Singh, External Affairs Minister Sushma Swaraj and Law Minister Ravi Shankar Prasad to look into the issue after the Supreme Court on 22 August 2017 in its verdict, termed the Islamic practice of Triple Talaq unconstitutional.

Meanwhile, according to the constitutional law, the government needs to pass the ordinance in the parliament within 6 months or else the validity of the ordinance will be over.
