Parliamentary Privileges Donโ€™t Shield Bribery: Supreme Court Verdict

Zaina Afzal Kutty

On Monday, the Supreme Court delivered a ruling on immunity in bribery cases for MPs and MLAs. The Chief Justice of India (CJI) highlighted that Parliamentary privileges donโ€™t protect bribery. Criticizing the PV Narasimha caseโ€™s judgment, the CJI emphasized that legislative privileges aim to create a fearless environment, highlighting the threat of corruption to Indian parliamentary democracy. He argued that the interpretation of the PV Narasimha judgment contradicts Articles 105 and 194, stressing that the offense of bribery is confirmed upon accepting illegal gratification, regardless of when the vote or speech occurs, thus completing the offense.
