New Delhi | Bhartiya Janta Party (BJP) MP Subramanian Swamy on Wednesday welcomed the Supreme Court’s verdict on the tussle between the center and AAP led Delhi government over the administrative control of the national capital.
Speaking to media, the Rajya Sabha MP said, “Yes what SC said is correct that LG must respect Delhi cabinet decisions.” However, he further added that, if any “anti-national security or anti-constitutional decision is taken, which they are capable of taking, as they are Naxalite type people, then LG can oppose.”

The Apex court bench today held that Lieutenant Governor Anil Baijal does not have independent decision-making powers, and is bound to act on the aid and advice of the Council of Ministers. The judgement pronounced in the court by Chief Justice Dipak Misra, who was heading a five-judge Constitution bench, also held that the LG cannot act as an “obstructionist”.
The Supreme Court in its verdict said that except for three issues, including land and law and order, the Delhi government has the power to legislate and govern on other issues. The LG needs to work harmoniously with the Council of Ministers and an attempt should be made to settle the difference of opinion with discussions, the bench added.
