Allahabad HC Dismisses Plea On Seeking Of Installation Of Loudspeaker In Mosque, Says “It Is Not A Fundamental Right”

Allahabad: A petition seeking the installation of loudspeakers in mosques was denied by the Allahabad High Court. “The installation of loudspeakers in mosques is not a fundamental right,” the court stated.

The order was issued on Wednesday by a division bench of Justice Vivek Kumar Birla and Justice Vikas, who stated, “The law says that using loudspeakers in mosques is not a constitutional right.”

Irfan contested the order given by Bisauli Sub-Divisional Magistrate (SDM) of Badaun district on December 3, 2021, in his plea. The SDM previously denied permission to build a loudspeaker for azaan at Noori Masjid in Dhoranpur village.

The petitioner claimed that the SDM’s order was “illegal” and “violates fundamental rights and legal rights” in his filing.

The use of loudspeakers in sacred areas has created debate in a number of regions, including Maharashtra and Uttar Pradesh.

Yogi Adityanath, the Chief Minister of Uttar Pradesh, recently stated that the sound from religious loudspeakers should not be heard beyond the premises.

Loudspeakers can be used in holy locations with permission, but the sound must not escape the premises, according to Yogi Adityanath. He also stated that no new permits for loudspeakers will be authorised.

Following Yogi Adityanath’s announcement, the volume of loudspeakers at the state’s 17,000 religious sites was reduced to the levels set for all religious sites in the state, including temples and mosques.
