Lakhimpur Case: “Witnesses Need To Be Protected”; SC Seeks UP Govt’s Response On Cancellation Of Bail Of Ashish Mishra

New Delhi: The Supreme Court Wednesday issued notice on a plea seeking cancellation of bail to Ashish Mishra, the son of Union Minister of State Ajay Mishra and an accused in the Lakhimpur Kheri violence case. Adding to it,the Supreme Court asked the Uttar Pradesh government to file a reply. The court will hear the case further on March 24.

A witness in the Lakhimpur Kheri case,was attacked on March 12, petitioner told the Supreme Court Bench

The Chief Justice of India-led bench asked the Uttar Pradesh government for a detailed report on the same and said witnesses must be protected.

“What is this? There is a specific allegation that a witness was attacked on March 12. You have to file a detailed affidavit,” the court said to the Uttar Pradesh state counsel.

Moreover, a notice has been issued to Ashish Mishra on the plea to cancel his bail.

Arguing in favour of cancellation of bail, senior advocate Dushyant Dave said, “The high court has erred in granting bail. It has ignored that the Supreme Court has taken suo moto cognizance and set up a special investigation team. By only looking at the FIR, the high court has said that a bullet injury was mentioned when there is no bullet injury.”

The petition to cancel bail of Ashish Misra was filed by Jagjit Singh, a relative of one of the farmers who died in the Lakhimpur Kheri incident.

Eight people, including four farmers, were killed on October 3 after violence erupted in Uttar Pradesh’s Lakhimpur Kheri.

The incident occurred at a farmers’ protest ahead of a visit to Lakhimpur by Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya. It has been alleged that a car with Ashish Misra in it ran over the protesting farmers, killing four of them. In the violence that ensued, another four people died.

In February, the Allahabad High Court granted main accused Ashish Misra bail in the case. He was arrested on October 9,
